Hokusei Law Office’s Ongoing Initiatives in the Field of Trust Law

February 2021 Naoshige Nakada, Attorney at Law

The Hokusei Law Office provides specialized services in the field of trust law. We are aware that some of our clients continue to study the subject of trust with deep knowledge and love of the field. We also continue to study the subject of Anglo-American trust laws and practices so that we can have meaningful discussions with them.

For example, partly because I had the good fortune of attending a class taught by Professor Tamar Frankel of Boston University around 2001, I was one of the reading group members to read and discuss Fiduciary Law, a book authored by Professor Frankel, together with other members consisting of professionals at Mitsubishi UFJ Trust and Banking Corporation, renown scholars of Anglo-American law and legal practitioners. The book was subsequently translated by some of the reading group members, and a wonderful Japanese translation of the book is now published. As I am very flattered and honored to find my name mentioned at the beginning of the translated book, here is an excerpt below:

・Fiduciary: “Takusareru Hito No Horiron” (Original title: Fiduciary Law), Tamar Frankel, translation supervised by Masayuki Tamaruya and translated by Mitsubishi UFJ Trust and Banking Corporation Fiduciary Law Study Group (Koubundou Publishers Inc. 2014)

An excerpt from “Foreword upon the publication of a Japanese translation version of Fiduciary Law” at the beginning of the book

I was first encountered with Fiduciary Law (hereinafter the “original book”) in 2011 when I was invited by Attorney Naoshige Nakada of Hokusei Law Office to join a reading group, including Professor Masayuki Tamaruya of Rikkyo University as one of its principal members, together with other colleagues from Mitsubishi UFJ Trust and Banking Corporation. One of my favorite places to visit is the Mitsubishi UFJ Trust and Banking Corporation Trust Museum near the Marunouchi north exit of Tokyo Station. Its collection showcasing the history of trust in Japan and overseas is unequaled in the world. By looking at the exhibition, we feel keenly that trust and the altruism behind it is universal both in the East and the West. My colleagues at Hokusei Law Office and I will continue to study and make efforts to sharpen our skills to be able to contribute to the further development of best practices in the field of trust.
